Fake Mississippi gun charges

On October 13, 2016, Amfibiyan was charged with possession of a handgun - for a second time. But he does not carry handguns or weapons. The charge is false. It is believed that the above charges form the basis of a patriot act surveillance application request to a Mississippi judge. Amfibiyan can not get arrested on the gun charges. Nor will Mississippi extradite him to prosecute the offenses. They already refused more than 20 times to prosecute. 

They believe that they do not have to extradite to  prosecute the offenses because they are not within the interstate agreement on detainers act, where an accused can challenge criminal charges from another jurisdiction in the state they are living in. Because Amfibiyan can not challenge the charges, they have been pending for more than nine years and interfere with housing, employment, and other background checks. The charges should have been dismissed as a matter of law in November 2019, two years after Mississippi refused to prosecute in November 2017, for failure to prosecute.

Amfibiyan believes October 2016 is the start date for BCI real world testing, because the charge is false. Amfibiyan was never arrested for handguns, anywhere, and this is similar to Amfibiyan being charged with 18 charges of domestic violence. For example, the October 13, 2016 arrest above doesn’t even have a case number. Thus, if Amfibiyan wanted to challenge the handgun by filing a motion to suppress or produce the handgun, there is no case number under which the handgun is filed.

For almost nine years, because of these charges, Amfibiyan is considered armed and dangerous which warrants a heightened police response anytime Amfibiyan comes in contact with law enforcement. In October 2020, the Pleasantville police department almost shot him, responding to a domestic violence call made by his ex-wife per her cooperation agreement with the Atlantic county prosecutor’s office.
