Fake mental illness defense

On October 11, 2025, at 6th and Santa Monica in Santa Monica, a man made an illegal u-turn to illegally park in a red zone/no parking area. He lightly hit Terry, the chief of CFS, with his car as Terry was crossing the street via the crosswalk. 

The man got out, apologized, then insulted Terry for smoking marijuana in public. After the man walked away and entered a store, Terry kicked off the car’s side mirrors. The man ran out of the store, chased Terry and assaulted him. 

The man was not charged with the apparent traffic violations or for assaulting Terry. Terry, however, was charged with vandalizing the car (Case# 25ARLF024090).

On January 22, 2026, Terry appeared before the Honorable Judge Ronald Owen Kaye, Los Angeles County courthouse, Hollywood - so-called “mental health diversion court”.

On November 27, 2025, in an email to C. Casillas, appointed counsel, Terry stated, among other things: “As for the charge, it's a misdemeanor. It comes down actual out of pocket loss when a vehicle is insured for vandalism. The loss does not include labor. He's insured and any loss would be his insurance premium increase. But I need this charge to remain in the superior court because then I may be able to get an X-ray with my attorney present. Once you see what was done to me, you will understand that the vandalism charge or circumstances were a part of real world testing and I should not be charged”. 

Ignoring the above, appointed counsel referred Terry for mental health diversion court. But, what she should have done was first get a court ordered physical examination via x-ray or MRI, to aid and assist Terry in advancing his defense to the charged. If it is true that Terry is implanted with  brain computer interface technology and the circumstances surrounding the car were a part of real world brain computer interface testing thus his actions are far from criminal.

Instead, appointed counsel chose to advance a mental illness defense to the charges which Terry does not agree with because it would be lying and an immature approach to avoid responsibility for his behavior.
